• AGENDA ITEM <br />• <br />• <br />STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND: <br />Julie Bartell, City Clerk <br />August 28, 2006 <br />Consider Adoption of Resolution No. 06 -138, <br />Authorizing a new off -sale liquor license and <br />tobacco license, for Brownstone Liquors, Inc. <br />d /b /a MGM Wines & Spirits, at 709 Apollo Drive <br />Simple Majority (3/5 Vote Required) <br />An application has been submitted by Brownstone Liquors, Inc., d /b /a MGM Wine <br />& Spirits, for a new off -sale liquor and tobacco license for a store to be located at <br />709 Apollo Drive (existing building within Lino Lakes Marketplace development). <br />The application is complete, the related fees have been paid, including <br />investigation fees, and insurance information has been provided to the City as <br />required. <br />The Lino Lakes Police Department has conducted a background investigation <br />relative to this application and found no information on the principal applicant that <br />would give a specific reason to deny the application. <br />In accordance with the Lino Lakes Code of Ordinances, Section 701 relating to <br />Liquor Licensing and Section 602 relating to Cigarette Sales, this application <br />requires approval by the City Council. <br />One concern has been raised by Community Development staff regarding this <br />application. The plans submitted for the liquor store don't indicate adequate <br />access for the deliveries the business will be receiving. The applicant will need <br />to demonstrate a suitable loading design as part of the building permit process. <br />The applicant is aware that approval is subject to all the provisions and <br />conditions of the laws of the city, state and federal government. <br />OPTIONS: <br />
