1 DRAFT of 6/14/06 <br />JOINT POWERS AGREEMENT <br />• TO PROTECT AND MANAGE THE <br />VADNAIS LAKE AREA WATERSHED <br />• <br />• <br />THIS AGREEMENT, made and entered into as of the last date of execution, herein, by <br />and between the participating units of government which are the City of Gem Lake, City <br />of Lino Lakes, City of North Oaks, City of Vadnais Heights, City of White Bear Lake <br />and White Bear Township. <br />The Vadnais Lake Area Water Management Organization (VLAWMO) created by this <br />Agreement is dependent upon the sincere desire of each member to cooperate in the <br />exercise of a joint power agreement to meet the requirements of the Metropolitan Surface <br />Water Management Act, re- codified as Minnesota Statute (M.S.) 103B Metro Surface <br />Water Management Act) and chapter 103D (Watershed Act), hereinafter referred to as <br />the "Act ". <br />SECTION I <br />GENERAL PURPOSE <br />It is the general purpose of the parties to this Agreement to establish an organization to: <br />1) Jointly and cooperatively develop a water management plan <br />and <br />2) Operate programs to: <br />(a) protect, preserve and use natural surface and groundwater storage and <br />retention systems; <br />(b) minimize capital expenditures necessary to correct flooding and water quality <br />problems; <br />(c) identify and plan for means to effectively protect and improve surface and <br />groundwater quality; <br />(d) establish more uniform local policies and official controls for surface and <br />groundwater management; <br />(e) prevent erosion of soil into surface water systems; <br />(f) promote groundwater recharge; and <br />(g) protect and enhance fish and wildlife habitat and water recreational facilities <br />and secure other benefits associated with the proper management of surface and <br />groundwater, and be in accordance with the Act. <br />The boundaries of the VLAWMO are set forth in the map as attached and hereafter <br />referred to as the "Area ". <br />Version: 6-14-06, <br />1 <br />VOW <br />P <br />sect. <br />Deleted: In general, the water <br />management plan may include projects <br />which accomplish the following:¶ <br /><# >Preserve and use natural water <br />storage and retention systems in order to <br />reduce to the greatest extent the public <br />capital expenditures necessary to control <br />excessive volumes and rates of runoff!! <br /><# >Protect and improve existing water <br />quality in lakes and streams through <br />proper land use and appropriate <br />conservation practices. ¶ <br /><# >Prevent flooding and erosion by <br />implementing floodplain management <br />and erosion and sediment control <br />programs!! <br /><# >Protect and enhance fish and wildlife <br />habitat and water recreational facilities by <br />reducing pollutant loads to lakes and <br />streams!! <br /><# >Undertake additional needed <br />programs to promote groundwater <br />recharge.¶ <br />< #> Provide a mechanism for the review <br />of local land and water management <br />plans. ¶ <br /><# >Provide a forum for resolution of <br />future intergovernmental disputes relating <br />to management and protection of the <br />Area!! <br /><# >Cooperate on a united basis on behalf <br />of all units of government within the <br />VLAWMO and with all other levels of <br />government to facilitate soil resource <br />protection and water management in the <br />Area. <br />I 11 <br />The above project descriptions are not <br />intended to be exclusive or overly <br />restrictive of the conservation plan and <br />I program, but rather are intended to act as <br />guidelines.¶ <br />i Deleted: 5 <br />1 <br />
