l Deleted: the <br />I Deleted: Each <br />{ Deleted: agrees <br />• <br />• <br />• <br />1 DRAFT of 6/14/06 <br />Each VLAWMO governmental unit shall pay to the organization: <br />1) The entire contribution amount due by January 15th of the year due <br />or. <br />2) One -half (1/2) of each members contribution by January 15th and the second <br />one -half (1/2) by August 156 <br />Failure to pay the required amounts by the due dates will cause a one (1) percent per <br />month service fee to be added to the amount due. <br />Subdivision 12. Capital Improvement Projects Program and Funding. On or before <br />June 1 of each year the Board shall prepare a capital improvements program and budget <br />for projects to be started or completed as described by the Water Plan and recommend its <br />approval by the governmental units in this JPA. Each proposed project shall be described <br />and its estimated cost and time for completion be provided. Only projects described in the <br />Water Plan or its amendments may be worked on, proposed and budgets made. <br />1) If money raised by the Special tax levy or by the Storm Water Utility is to be used <br />for Capital Projects the JPA members shall be provided the opportunity to review <br />and must approve the proposed amount of the tax levy that will be used for <br />Capital Projects within sixty (60) days of receipt of the Board's <br />recommendations.. <br />2) If ;capital project is to be funded wholly or in part bye or more governmental <br />unit( s), they will be provided the opportunity ,,to review and approve or disapprove <br />the capital improvement program within sixty (60) days of receipt of the Board's <br />recommendations. <br />3) If service fees ,_grants,,_interest or other funding sources are available the source <br />and amounts of such funds shall be shown. <br />If the capital improvement buddaet item is approves each governmental agrees to <br />.............. <br />contribute its agreed to proportionate share of the cost of constructing said capital <br />improvement for projects within the VLAWMO Watershed. <br />Subdivision 4. Arbitration for improvements initiated by the Water Plan All JPA <br />governmental units shall comply with the VLAWMO Board of Commissioners <br />determinations as to the force and effect of the Watershed Management Plan, the Local <br />Water Management Plans and any cost allocations for improvements initiated pursuant to <br />these plans. <br />Any governmental unit which disputes a determination by the Board as to force and <br />effect of the Watershed Management Plan, any Local Water Management Plan, or the <br />cost allocations for improvements, initiated pursuant to these plans, may submit the <br />dispute to arbitration.
