1 <br />• <br />• <br />1 DRAFT of 6 /14/06 <br />In either case, (1 or 2) after study, and approval by two- thirds (2/3) of the <br />Commissioners, the Board shall provide the affected governmental unit with a <br />recommendation including the total estimated cost and description of the relative extent <br />of the benefits to be realized by those affected and the costs to be borne based on benefit. <br />16. Water Conveyances. The Board may order any City, governmental <br />unit or units to construct, clean, repair, alter, abandon, consolidate, reclaim or change the <br />course of terminus of any ditch, drain, storm sewer, water course, natural or artificial, that <br />affects the VLAWMO Watershed in accordance with adopted plans. <br />17. Watershed Operations. The Board may order any City to acquire, <br />operate, construct or maintain dams, dikes, reservoirs and appurtenant works in <br />accordance with adopted plans. <br />Subdivision 18. Storm and Surface Waters. The Board shall regulate, conserve and <br />control the use of storm and surface water within the VLAWMO Watershed pursuant to <br />its adopted plan. <br />Subdivision 19. Insurance. The Organization may contract for or purchase such <br />insurance as the Board deems necessary for the protection of the Organization. <br />Subdivision 20. Audit. The VLAWMO Board shall make an annual audit of the books <br />and accounts of the Organization and shall make and file a report to all of the <br />governmental units of this JPA at least once each year including the following <br />information: <br />a. the financial condition of the Organization; <br />b. the status of all Organization projects and work within the watershed; <br />c. the business transacted by the Organization and other matters which affect the <br />interests of the Organization. <br />Copies of said report shall be transmitted to the clerk of each governmental unit in the <br />JPA. <br />Subdivision 21. Records. The Organization's books, reports and records shall be <br />available for and open to inspection by all governmental units at all reasonable times. <br />Subdivision 22. Entrance upon land. The Board or its designated representatives may <br />enter upon lands within or outside,the VLAWMO Watershed to make surveys and <br />investigations to accomplish the purposes of the Board. The Board shall be liable for <br />actual damages resulting therefrom, but every person who claims damages shall serve the <br />Chairman or Secretary of the VLAWMO Board with a notice of claim as required by <br />M.S.A. 466.05. <br />Subdivision 23. Other Powers. The Board may exercise all other powers necessary and <br />incidental to the implementation of the purposes and powers set forth herein as <br />authorized by the governmental units that comprise this JPA. <br />I Version:_6 -14 -06 10 <br />{_Deleted: without <br />{ Deleted: 5 <br />
