AGENDA ITEM 6.B. • STAFF ORIGINATOR: Paul Bengtson MEETING DATE: September 11, 2006 TOPIC: Resolution 06 -145 Conditional Use Permit — Private Dog Kennel 575 Ash Street BACKGROUND Margo Polta has requested approval of a Conditional Use Permit to allow a private dog kennel at 575 Ash Street. This application is required due to the current animal ordinance which limits the number of dogs kept on this property. The dog ordinance of the city code limits the number of dogs on a property to two. This can be increased to four with the approval by the city of a Conditional Use Permit and a license for a private dog kennel. The applicant is proposing to keep three adult dogs on the premises. ANALYSIS • Comprehensive Plan, Land Use and Zoning: The table below identifies the existing land use and zoning as well as guided land uses for the area. A Dog Kennel is listed as a conditional use within the R (Rural) zoning district and the conditions included are as follows: a. The applicable provisions of Section 503 of the City Code relating to the keeping of animals are determined to be satisfied. 40 Section 503 of the City Code is the basic animal portion of the city code. Section 502 and 607 include specific standards for dogs and dog kennels that will need to be complied with on this site. A staff recommended condition is included with the report which requires compliance with both City Code sections. - 5 2 -
