MEETING DATE: September 25, 2006 <br />TOPIC: First Reading, Ordinance No. 10 -06, Rezone <br />Lot 16, Block 1, Millers Crossroads (Southeast Corner <br />of Birch/Hodgson) <br />From LB Limited Business to NB Neighborhood <br />Business <br />ACTION: 3/5 vote <br />BACKGROUND <br />The subject site is located at the southeast corner of Birch St. and Hodgson Rd. During <br />the recent discussion of site development, it became apparent that the existing zoning <br />classification of the parcel (LB, Limited Business) is inconsistent with the City Council's <br />intent when it rezoned the property in September 2003. Specifically, the LB zone <br />provides for auto orientated uses that are not allowed in the NB, Neighborhood Business <br />zone. The commercial site is abutting and accessed through the Millers Crossroads <br />residential development. The City Council wants to minimize impacts on those residents <br />caused by commercial activity. The potential for impacts would increase as traffic <br />increases, and auto oriented uses would increase the potential for increased traffic. <br />Rezoning the site to NB would avoid such impacts. <br />This rezoning should be completed as soon as possible to eliminate uncertainty for this <br />site with immediate development application potential. <br />OPTIONS <br />1. Approve Ordinance No. 10 -06 rezoning the Millers Crossroads commercial site from <br />LB Limited Business to NB Neighborhood Business. <br />2. Deny the rezoning. <br />3. Return to staff with direction <br />RECOMMENDATION <br />Option 1 <br />
