MEETING DATE: September 25, 2006 <br />TOPIC: Resolution 06 -156: Amendment to Conservation <br />Easement Covenants and Restrictions <br />Foxborough <br />VOTE: 3/5 <br />BACKGROUND <br />The City Council accepted a conservation easement for the Foxborough when it approved <br />the final plat with Resolution 05 -121. The easement is created and described in a <br />document called the "Conservation Easement, Covenants and Restrictions ", which was <br />approved with the same resolution. <br />Paragraph 4.D. of that document prohibits the construction of structures in the easement <br />other than stormwater facilities. The developer has constructed a monument sign within <br />the easement and has requested that the City agree to amend the easement document. <br />The sign does not interfere with any of the ecological restoration or management <br />activities. <br />The attached document amends the easement covenants by adding a phrase that allows <br />the entrance monument to be constructed in the conservation easement. <br />OPTIONS <br />1. Approve Resolution 06 -156 amending the conservation easement for Foxborough. <br />2. Return to staff with direction. <br />RECOMMENDATION <br />Option 1 <br />
