• Council Member introduced the following resolution and moved its adoption: • • CITY OF LINO LAKES RESOLUTION NO. 06 -161 RESOLUTION APPROVING REQUEST FOR PAYMENT FROM THE MUNCIPAL TURNBACK ACCOUNT (FORMER TRUNK HIGHWAY 49) WHEREAS, a portion of State Trunk Highway 49 (4th Avenue from Lilac to the entrance of the Minnesota Correctional Facility) was turned back to the City of Lino Lakes in 1996; and WHEREAS, the City is eligible to receive a cash payment in lieu of reconstructing the portion of roadway at this time, and WHEREAS, this segment of 4th Avenue is listed within the "Good" Category (Highest Category) of the City's Pavement Management Program. Based on the roadway condition rating there is no need to reconstruct 4th Avenue within the next five years, and WHEREAS, these funds are for use by the City on the state aid system. The City has several higher priority State Aid street needs where these funds can be used. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LINO LAKES, MINNESOTA: 1. Hereby approves the request for payment from the Municipal Turnback Account for former Trunk Highway 49 in the amount of $955,404.00, and 2. Authorizes staff to execute the necessary agreements on behalf of the City. John J. Bergeson, Mayor Julianne Bartell, City Clerk Adopted by the Lino Lakes City Council this 9th day of October, 2006. The motion for the adoption of the foregoing resolution was duly seconded by Council Member and upon vote being taken thereon, the following voted in favor thereof: The following voted against same: Whereupon said resolution was declared duly passed and adopted.
