• <br />allow governmental units up to 6 months to review and comment. The City <br />cannot submit the plan to Metropolitan Council until this time period has elapsed <br />or all comments have been received. Therefore, while the draft plan should be <br />completed prior to October 30, 2007 we cannot insure that it is submitted to <br />Metropolitan Council for formal review by this time. Additionally, under state law <br />all property owners have the right to request a Comprehensive Plan Amendment <br />and the City is required to review such request within 60 days of a complete <br />application. <br />4) The developer has requested that upon completion of the environmental <br />review process they be allowed to submit a Preliminary Plat Application and <br />Rezoning application with any approvals conditioned on approval of the comp <br />plan update or an amendment to the comp plan. Staff is not comfortable with <br />this request as it stands. We do not for see any problem with this process if it <br />follows completion of the Environmental Review process and City approval of the <br />draft plan. This is anticipated for completion in July of 2007. Staff believes this <br />still provides adequate time for the developer to commence the preliminary plat <br />process by November 1, 2007. <br />REQUESTED COUNCIL ACTION <br />• Staff is requesting council response to the developers request and direction on <br />whether or not to proceed. <br />ATTACHMENTS <br />1.
