WS -4 <br />WORK SESSION STAFF REPORT <br />Work Session Item No. 4 <br />Date: Council Work Session, November 6, 2006 <br />To: City Council <br />From: Gordon Heitke <br />Re: Request for Exception from City Code <br />Background <br />At the October 9, 2006 council work session City staff reported that they had received a <br />request to grant an exception from Section 402.02 of the City Code to not require the <br />connection of Old St. Joes Church to the city sewer system. A copy of the request with <br />reasons is attached. It has been explained to staff that the restored building will be used <br />for special events such as weddings. <br />Mr. Brausen has also inquired as to whether the code could be amended to accomplish his <br />request. Staff has no recommendation for amendment of this section of the code. <br />Staff was directed at the October 9, 2006 council work session to seek an opinion from <br />the City Attorney. His response is attached. <br />Staff finds that the proposed use of the facility, which includes human occupancy and <br />human use of the building, does not meet the grounds for exemption by the council as <br />allowed for in Section 402.02, first paragraph. Staff maintains the opinion that there are <br />no grounds for an administrative permit allowed for under Section 402.13 <br />Requested Council Direction <br />Staff is seeking direction from the City Council as to whether it will consider action to <br />exempt the Old St. Joes Church building from the sewer connection requirement of <br />Section 402.02 of the City Code, or whether the Council wishes to consider amending <br />this section of the code to accomplish the request. <br />
