Memorandum <br />To: Bill Hawkins <br />From: Gordon Heitke <br />Date: October 18, 2006 <br />Re: Code Exception, Conflict <br />134.ckl k (PIfo <br />ncl uGF.e cP r: <br />Attached is the staff report on a request from St. Joes Church to not be required to <br />connect to the city sanitary sewer system as required by code. The council asked that I <br />refer this matter to you for your opinion as to whether the Council has grounds to exempt <br />the building from the code requirement. <br />Staff finds no basis for an exemption, nor does staff know of any basis for amending the <br />code in order for their request to be granted. Another concern that staff has is the <br />estimation that the church will be used for human occupation approximately once per <br />month. I'm not sure how accurate that prediction will turn out to be once the building is <br />finished and starts being used and how demand for the building will increase in future <br />years as the population of the City increases. <br />On another issue, Council member Carlson removed herself from the discussion as she <br />holds certain positions in the congregation. She indicated that she would be contacting <br />you requesting an opinion as to whether she has a conflict of interest. Since I'm in no <br />position to explain her positions, this is probably the most efficient way to handle the <br />inquiry, however, I think that I should be provided a copy of the opinion in order for it to <br />be part of our records and in the case that it needs to be presented to other members of the <br />Council or public. <br />cke4- ��141 <br />
