The total appraised value of the right -of- 2 way to be acquired is approximately $1,300,000. Offer letters, accompanied with a copy 3 of the property appraisal, were distributed to property owners as of September 27, 2006. 4 5 Community Development Director Grochala stated the City is nearing agreement on 6 several parcels and Mr. Wilson will continue to work with property owners to reach an 7 agreement for direct purchase. However, to insure that ongoing property negotiations do 8 I not jeopardize the project construction or state and County funding staff will be 9 requesting Council authorization, on November 13, 2006, for the City Attorney to 10 commence with eminent domain proceedings. Through this process the City Attorney 11 will be seeking District Court approval to acquire parcels by eminent domain and 12 authorizing quick take provisions that establish a possession date. Again, staff is hopeful 13 that all acquisition can be obtained by direct purchase and will continue to negotiate with 14 property owners throughout the process. 15 16 Community Development Director Grochala advised the estimated project cost is 17 approximately $10,200,000. Anoka County has provided $4.1 million in their 2007 18 budget for the project. The City was recently notified that Mn/DOT approved the 19 application for Local Road Improvement funding in the amount of $400,000. This brings 20 Mn/DOT's total contribution to $800,000. City staff is working with Springsted Inc., and 21 Kennedy & Graven to evaluate funding options for the remaining $5.7 million. 22 23 This item will appear on the regular Council agenda Monday, November 13, 2006, 6:30 24 p.m. 25 26 LAKEWOOD APARTMENTS — LEGACY AT WOODS EDGE 27 28 Community Development Director Grochala advised at the October 23, 2006 City 29 Council meeting the Hartford Group asked the City Council to consider an amendment to 30 the PUD for the Lakewood Apartments. Part of that amendment was consideration of a 31 request to remove the balconettes from the exterior elevation of the building. Council did 32 not approve the removal of balconettes and requested that Hartford Group revisit options 33 regarding the elevation of the building. 34 35 Mr. Frank Janes, Hartford Group, came forward and outlined a memo indicating Hartford 36 Group is moving forward with the removal of the balconettes.
