216 <br />PROPOSED CHANGE <br />Delete this section or clarify it to apply only to candidates for mayor <br />and city council. <br />REASON <br />It is unclear whether this provision as written is intended to apply <br />just to candidates for city offices, or any candidate for any office. <br />Under M. S. § 211A.02, a home rule charger city may adopt <br />provisions like these relating to city elections. But, not even a home <br />rule charter city may not require campaign fmance reports from <br />candidates for public office, other than persons running for city <br />elections. <br />216.03, Subd. <br />2 F and G. <br />PROPOSED CHANGES <br />Delete these two paragraphs. <br />REASON <br />The citations are to definitions, not restrictions or prohibitions. If <br />these uses of campaign funds are restricted by state law, then these <br />restrictions exist in other parts of state law and need not be <br />referenced in the city code. <br />216.03, Subd. <br />4, paragraph <br />I <br />PROPOSED CHANGE <br />Delete this paragraph. <br />REASON <br />Who or what is the city's election board referenced here? This term <br />is not defined in 216.01 and I find nothing in the code creating such a <br />board. <br />216.05 <br />PROPOSED CHANGE <br />In the first two paragraphs, the reference "Per State Statute" should <br />be deleted and a reference to "M. S. § 211A.12, as it may be <br />amended from time to time" inserted. In the third paragraph, a <br />reference to M. S. § 211A.12 as it may be amended from time to <br />time" could be substituted. <br />REASON <br />If statutes are to be relied upon, then the reference should be <br />complete. <br />
