• <br />JOINT POWERS AGREEMENT <br />BETWEEN THE CITY OF CIRCLE PINES <br />AND <br />CITY OF LINO LAKES <br />THIS AGREEMENT is made as of January , 2008 between the City of Circle <br />Pines, Minnesota, a municipal corporation ( "Circle Pines ") and the City of Lino <br />Lakes, Minnesota, a municipal corporation ( "Lino Lakes "). <br />RECITALS <br />A. The cities are interested in formalizing cross community water and sewer <br />connections along North Road. <br />B. Circle Pines owns and maintains water main and sanitary sewer facilities <br />adjacent to certain parcels located in Lino lakes. The Metropolitan <br />Council — Environmental Services also owns and maintains sewer lines. <br />These facilities have the capacity to provide water and sanitary sewer <br />service to Lino Lakes residents on or near North Road. <br />C. It is desire of the parties, the Cities of Lino Lakes and Circle Pines, <br />through this agreement, to provide for water and sanitary sewer services <br />to residents in the North Road area in Lino Lakes. <br />D. Minnesota Statutes, Section 471.59, provides that two or more <br />governmental units, by agreement entered into through action of their <br />governing bodies, may jointly or cooperatively exercise any power <br />common to the contracting parties or any similar powers, including those <br />which are the same except for the territorial limits within which they <br />exercised. <br />E. This agreement is effective retroactive to January 1, 1996. All previous <br />charges will be billed at the yearly utility rates in effect at the time of <br />consumption /use. <br />AGREEMENT <br />Based upon the foregoing recitals, Circle Pines and Lino Lakes agree as follows. <br />1. Circle Pines shall allow water and sewer usage from approved Lino Lakes <br />residents on or near North Road to flow through water mains and sanitary <br />sewer lines owned and maintained by Circle Pines. <br />Page 1 of 3 <br />—35c- <br />
