Grant No. SG -00 -135 • <br />AGREEMENT EXTENDING GRANTEE'S OBLIGATION TO COMPLY WITH <br />LIVABLE COMMUNITIES DEMONSTRATION ACCOUNT <br />GRANT AGREEMENT CONDITION <br />'1111S AGREEMENT is made and entered into by the Metropolitan Council ( "Council ") and the <br />City of Lino Lakes ( "Grantee "). <br />WHEREAS, on December 20, 2000 the Council awarded the Grantee $450,000 in Livable Com- <br />munities Demonstration Account grant funds to help support mixed- income housing components <br />of The Village development located in the City of Lino Lakes; and <br />WHEREAS, the Council's grant award was subject to two conditions: (1) the Grantee's agree- <br />ment not to impose annual limits on the issuance of building permits connected with The Village <br />development; and (2) the installation of a traffic signal on the northbound off-ramp of I -35W to <br />serve The Village and existing development in the City of Lino Lakes; and <br />WHEREAS, on March 13, 2003 the Council and the Grantee entered into a grant agreement <br />identified as Council Grant No. SG -00 -135 which made the Grantee's receipt of the grant funds <br />subject to the Council's two grant award conditions; and <br />WHEREAS, in an August 24, 2005 letter the Grantee requested payment of the $450,000 grant <br />amount even though the traffic signal had not yet been installed; and <br />WHEREAS, on September 13, 2005 the Lino Lakes City Council adopted Resolution No. 05 -140 <br />stating the Grantee's agreement to "reimburse the Metropolitan Council by January 31, 2008 the <br />entire $450,000 grant amount if a traffic signal is not installed on the northbound off -ramp of I -35W <br />and operational by December 31, 2007"; and <br />WHEREAS, at its September 14, 2005 meeting the Council's governing body authorized payment <br />of the $450,000 grant amount to reimburse the Grantee for eligible grant- funded expenditures <br />prior to installation of the traffic signal subject to: (1) the Grantee's agreement to reimburse the <br />entire $450,000 amount if the traffic signal was not installed and operational by December 31, <br />2007; and (2) the Grantee's formal acknowledgment of the reimbursement condition; and <br />WHEREAS, on September 30, 2005 the Council and the Grantee executed an amendment to <br />Grant No. SG -00 -135 under which the Grantee agreed to reimburse the Council by January 31, <br />2008 the entire $450,000 grant amount if the traffic signal was not installed and operational by <br />December 31, 2007; and <br />WHEREAS, in a November 19, 2007 letter the Grantee informed the Council that reconstruction <br />of the I- 35W/Lake Drive (CSAH 23) interchange was underway but indicated "the signal systems <br />will not be installed and operational until the spring of 2008 "; and <br />Page 1 ,,f.2 Pages <br />
