Consider Reading of Orthnance No. 17 -07, Vacating a portion of the 139 drainage and utility easement on Lot 16 Black 4 of the recorded plat Park Grove 140 141 Since an inadequate number of council members were present to approve the ordinance, the 142 council opted to postpone consideration except that the public hearing would be opened and 143 continued... 144 145 Mayor Bergeson opened the public hearing at 730 p.m. There was no one present wishing to 146 speak 147 148 Council Member Gallup moved that the public hearing be continued to January 28, 2008. 149 150 Marshan Meadows 2nd Addition 151 Resolution No. 08-07, Approving Preliminary Plat, Marshan Meadows 2" Addition; 152 Resolution No. 08-05, Approving Development Agreement for Marshan Meadows 2" 153 Addition; 154 Resolution No. 08-OS, Approving Final Plat for Marshan Meadows 2" Addition, Paul 155 Bengtson 156 157 City Planner Bengtson noted that Brtiggeraan Homes has requested approval of a two lot 158 residential subdivision to be known as Marshan Meadows 273d Addition. A report ontTining a 159 proposed preliminary plan, development agreement and final plan was presented_ Staff is 160 recommending approval of the project with conditions noted in the report except that condition 161 number six should be removed.. 162 Staff will also correct a discrepancy in the development agreement regarding the developer's 163 deposit; it should read that 35% of the total estimated cost of city improvements is required. 164 165 Council Member Stott moved to approve Resolution Nos. 08 -07, 08 -05, and 08-08 as presented 166 and corrected_ Council Member Gallup seconded the motion. Motion carried. 167 168 Resolution No. 08-10, Accepting Land Donation, Outlot A, Woodridge Estates and Outiot B, 169 Woodridge Estates - City Planner Smyser explained that the developer of the Woodridge Estates 170 neighborhood wishes to donate two wetland outlots that are landlocked and usable for development 171 Staff recommends that the city accept the donation. 172 173 Council Member Gallup moved to approve Resolution No. 08 -10 as presented. Council Member 174 Stoltz seconded the motion. Motion cared. 175 176 Resolution No. 08-04, Approving Final Payment, 2007 Street Overlay Project - City Engineer 177 Studenski reported that the 2007 Overlay project has been satisfactorily completed and staff-is 178 recommending final payment to the contactor, WB Miller, Inc. 179 180 Cotmci Member Stoltz moved to approve Resolution No. 08 -04 as presented.
