Additionally, the flood plain elevation level will need to be covered <br />with an easement. <br />Grading: The grading plan has been reviewed by the City Engineer and his comments will <br />need to be addressed to his satisfaction prior to the site being developed. <br />Park Dedication: There is no land dedication needed, as Quail Ridge Park is nearby, so the <br />typical park dedication fee will be collected with the Development Agreement. <br />Environmental Board: The Environmental Board reviewed the project on November 28, <br />2007. Their comments are attached. The most important of those being that they suggest <br />increasing the lot to include a portion of Outlot A so the structure can be removed from the <br />floodplain and the shore impact zone disturbance can be minimised <br />Planning and Zoning Board: The board held a Public Hearing on January 9, 2007, and <br />voted 3 -2 to recommend approval of the item. The statutory deadline for action necessitated <br />them making a recommendation on the item with a condition requiring the changes that have <br />been done by the developer since that meeting. The board expressed concern over offering a <br />recommendation prior to the revisions and this was the cause for the outcome of the vote. <br />RECOMMENDATION <br />Staff is recommending approval of the First Reading of Ordinance 02 -08, approving the <br />Rezoning, and approval of Resolution 08 -22, approving the Preliminary Plat for Vaughan's 1st <br />Addition, subject to the following conditions: <br />1. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. <br />2. A development agreement between the city and the developer must be executed prior to the <br />issuance of any building permits for the site. <br />3. The final plat must clearly depict all required drainage and utility easements. <br />4. The Rice Creek Watershed District must review the project prior to building permits being <br />issued by the city for any new construction. <br />5. A boulevard tree shall be provided for each lot frontage. <br />6. Park dedication must be paid in accordance with the city's fee schedule. <br />7. Any development of the land contained in Outlot A will first require replatting that land as a <br />developable lot. <br />8. As depicted on the utility plan, only one drive access will be allowed from Lot 1 Block 1 <br />onto Ruffed Grouse Road. <br />9. Any additional impervious surface coverage proposed for the site will need to be reviewed <br />and approved by city staff.
