• February 27, 2008 <br />• <br />• <br />Dear City of Lino Lakes Council Members: <br />I am writing on behalf of Miller's on Main and the Blue Heron Days <br />Committee. I am requesting a variance from the State Fire Code. The <br />variance is for the tent that is used for Blue Heron Days weekend at Milers <br />on Main. The tent has been used for the street dance, royalty coronation, <br />taco- eating contest, among other things. The same size tent has been used <br />from 2003 -2007, plus for the benefit for officer Silvera. It was brought to <br />our attention that the tent does not meet the state fire code for being 20' from <br />each property line. This code is in place for the safety of the public. <br />I feel that we meet most of the code requirements and cause no concern for <br />the public's safety. We are 20' from the property line to the East, West, and <br />South. To the north we are not 20' from the property line, however you can <br />see from the enclosed site plan that the side of the tent to the north is <br />completely closed off by a wall. That being the case there is no way for <br />people to exit that direction anyway. I have been told by the fire department <br />that the openings to the west and south are sufficient enough for this size <br />tent. <br />If we are unable to obtain this variance we will be unable to proceed with the <br />above mentioned activities for Blue Heron Days weekend. I feel that it <br />would be major disappointment for the community. <br />To summarize, I am requesting the City Council of Lino Lakes to grant a <br />variance for the state fire code that states all tents need to be at least 20' <br />from each property line. Lastly, the council should know that in the state <br />fire code it is stated " governing bodies are not liable for damages in <br />connection with granting variances, abatements, denials, or modifications of <br />orders from the fire code that are made in good faith." <br />I thank you for considering this request and hope to see everybody that <br />weekend. <br />Sincerely, <br />% <br />ad A.
