• <br />• <br />• <br />STAFF ORIGINATOR: <br />COUNCIL MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />AGENDA ITEM NO. 5A <br />Rick DeGardner, Public Services Director <br />June 9, 2008 <br />FIRST READING: Ordinance 09 -08, Amending The <br />City Code, Section 304 to Include Administration and <br />Regulation of Public Right -Of -Way <br />Simple Majority <br />BACKGROUND: <br />As discussed at the May 5th and June 2nd City Council Work Sessions, staff is <br />recommending that the City Code be amended to include a Right -of -Way Ordinance. <br />The attached Right -of -Way Ordinance outlines the permit requirements, application <br />process, and issuance of permits. This ordinance also establishes acceptable patching <br />and restoration standards, and requires that mapping data (as -built drawings) be <br />submitted to the City upon completion of the work. This ordinance also addresses the <br />location and relocation, installation and reinstallation of facilities in the right -of -way <br />pertaining to the City's desire to place utilities underground whenever feasible. <br />The list of fees and charges will be established /included in the City's Fee Schedule and <br />includes a degradation fee formula which comes into play whenever a portion of the <br />paved road or trail surface is removed. This allows the city to recover costs associated <br />with the decrease in the useful life of the right -of -way caused by the excavation. <br />The proposed Right -of -Way Ordinance brings all companies under one uniform set of <br />standards, streamlines the franchising process, and removes questions about the extent <br />of the City's authority over non - franchised utilities such as the telephone companies. <br />OPTIONS: <br />1. Approve First Reading of Ordinance 09 -08, Amending The City Code, Section 304 to <br />Include Administration and Regulation of Public Right -Of -Way <br />2. Return to staff. <br />RECOMMENDATION: <br />Option 1. <br />
