• • • STAFF ORIGINATOR: COUNCIL MEETING DATE: TOPIC: VOTE REQUIRED: AGENDA ITEM NO. 5A Rick DeGardner, Public Services Director June 9, 2008 FIRST READING: Ordinance 09 -08, Amending The City Code, Section 304 to Include Administration and Regulation of Public Right -Of -Way Simple Majority BACKGROUND: As discussed at the May 5th and June 2nd City Council Work Sessions, staff is recommending that the City Code be amended to include a Right -of -Way Ordinance. The attached Right -of -Way Ordinance outlines the permit requirements, application process, and issuance of permits. This ordinance also establishes acceptable patching and restoration standards, and requires that mapping data (as -built drawings) be submitted to the City upon completion of the work. This ordinance also addresses the location and relocation, installation and reinstallation of facilities in the right -of -way pertaining to the City's desire to place utilities underground whenever feasible. The list of fees and charges will be established /included in the City's Fee Schedule and includes a degradation fee formula which comes into play whenever a portion of the paved road or trail surface is removed. This allows the city to recover costs associated with the decrease in the useful life of the right -of -way caused by the excavation. The proposed Right -of -Way Ordinance brings all companies under one uniform set of standards, streamlines the franchising process, and removes questions about the extent of the City's authority over non - franchised utilities such as the telephone companies. OPTIONS: 1. Approve First Reading of Ordinance 09 -08, Amending The City Code, Section 304 to Include Administration and Regulation of Public Right -Of -Way 2. Return to staff. RECOMMENDATION: Option 1.
