F. FIRM PHILOSOPHY <br />We believe our underlying philosophy of public law practice serves our clients well. First, since our <br />primary area of practice is governmental law, we are extremely experienced and informed as to statutory <br />and case law developments affecting public bodies. Due to our level of experience and knowledge in <br />municipal law, our clients have seldom needed to hire outside counsel for complex or unusual cases or <br />legal issues. Second, we are responsive and timely in addressing legal issues referred to us by our <br />clients. Third, we believe that a public body requires aggressive representation of its interests, which we <br />successfully provide our existing clients. Finally, we attempt to insure that our clients follow correct <br />legal procedures, make informed decisions, and express legally sustainable reasons for the actions taken. <br />G. MALPRACTICE / LIABILITY INSURANCE <br />Sweeney, Borer & Sweeney has current professional liability insurance with Minnesota Lawyers Mutual <br />Insurance Company, policy #3419 -20, with limits of $1,000,000.00 per claim and $3,000,000.00 <br />aggregate, with a deductible of $5,000.00, and an expiration date of November 23, 2008. In addition, <br />our general liability insurance is through Travelers, policy number 23E02221 680, in the general <br />aggregate amount of $2,000,000.00, with an expiration date of May 3, 2008. If any additional insurance <br />information or documentation is necessary, please contact Patrick J. Sweeney. <br />H. CONFLICT OF INTEREST <br />No member of our firm represents any client whose representation would in any way conflict with our <br />ability to provide legal services to the City of Lino Lakes. The members of our firm do not currently <br />represent any real estate developers. Our managing partner examines the opening material relating to <br />every file to determine there is no conflict of interest with existing clients or previously existing clients <br />prior to authorizing the opening of the new file. <br />I. FEES <br />1. City Attorney — Civil. <br />We have reviewed the legal services requirements for the City Attorney set forth in your Request for <br />Proposals. We propose performing such civil legal services as follows: <br />- $350.00 flat fee per Council Meeting <br />(including preparation time and workshops). <br />- $135.00 per hour for all other civil legal services, as directed by the City Administrator. <br />Please be advised that our law firm will consider any other billing arrangement, such as a monthly civil <br />retainer, if the City so desires. <br />13 <br />
