COUNCIL MINUTES July 28, 2008 <br />DRAFT <br />127 Restaurant, Holiday Station (Blaine), Liz Sheehy, Matthew's Restaurant, Michel lo's, Precision <br />128 Tune, Red Oak Restaurant, Waldoch Farms, YMCA, Exxon Mobil Gas. <br />129 <br />130 Council Member Gallup moved to accept the donations for the Senior Safety Fair as presented. <br />131 Council Member Stoltz seconded the motion. Motion carried on a voice vote. <br />132 <br />133 4E) Consider Resolution No. 08 -78, Approving the Joint Powers Agreement to provide <br />134 law enforcement assistance in support of the 2008 Republican National Convention. <br />135 Captain Strege reported that the Police Department has received a request from the St. Paul <br />136 Police Department for assistance in providing public safety services related to the upcoming <br />137 Republican National Committee to be held in St. Paul. A joint powers agreement is before the <br />138 council that would establish an arrangement whereby the City can provide that assistance and be <br />139 compensated for said services. <br />140 <br />141 The council confirmed that police staffing levels in the city will be maintained; officers assigned <br />142 to this special duty will be on overtime. <br />143 <br />144 Council Member Reinert moved to approve Resolution No. 08 -78, as presented. Council <br />145 Member O'Donnell seconded the motion. Motion carried on a voice vote. <br />146 <br />147 4F) Consider Resolution No. 08 -79, Accepting grant funds from the Minnesota <br />148 Department of Homeland Security and Emergency Management. Captain Strege reported <br />149 that the Police Department is requesting authority to accept grant funds from the Minnesota <br />150 Department of Homeland Security and Emergency Management to be used for the Community <br />151 Emergency Response Team (CERT). <br />152 <br />153 Council Member Gallup moved to approve Resolution No. 08 -79, as presented. Council <br />154 Member O'Donnell seconded the motion. Motion carried on a voice vote. <br />155 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />156 There was no report from the Public Services Department <br />157 COMMUNITY DEVELOPMENT REPORT, MICHAEL GROCHALA <br />158 6A) Consider Resolution No. 08 -80, Approving a Variance to the Shoreland Ordinance's <br />159 ordinary high water level setback, Paul Bengtson <br />160 <br />161 Planner Bengtson reported on a request for a variance from the Shoreland Ordinance for 7625 <br />162 Peltier Lake Drive. The variance relates to placement of a private sewer septic system on the <br />163 site. There are many requirements involved in septic system projects, including set backs. The <br />164 applicant currently has a failed septic system in place. The proposal is to build a box mound <br />165 system with a retaining wall (30 by 54 feet) above the old system, a process approved by the <br />166 Minnesota Pollution Control Agency. This would produce a terrace affect in the back yard. City <br />167 staff has reviewed the request in consideration of state mandated requirements related to <br />168 variances (the lot was created prior to the ten acre and 150 foot set back rule). The Planning and <br />169 Zoning Board approved this request on July 9, 2008 with a request for the revised site plan that is <br />-4- <br />• <br />• <br />
