Memorandum <br />To: City Council <br />From: Gordon Heitke <br />Date: September 18, 2008 <br />Re: Investigation of Allegation of Open Meeting Law Violation <br />Based on comments stated during the September 8, 2008 meeting by a majority of <br />council members regarding their desire to have an investigation conducted of an alleged <br />open meeting law violation, staff sought advice from Mr. Tom Grundhoefer, General <br />Counsel of the League of Minnesota Cities. Upon request, Mr. Grundhoefer has provided <br />a list of law firms which are qualified to conduct such an investigation (see attached e- <br />mail). <br />In order for this investigation to be conducted by an independent party with no known <br />connections to the City of Lino Lakes, the city council or staff, the council should <br />consider George Hoff (Hoff, Barry and Kozar) or Tim Kuntz (Levander, Gillen and <br />Miller). <br />Kennedy and Graven and the Campbell Knutson law firms are being considered to serve <br />as civil attorneys for the city and Scott Lepak of Barna, Guzy and Steffen currently <br />provides legal services to the city. <br />Attachment: Tom Grundhoefer e-mail, 9/11/2008 <br />
