AGENDA ITEM 1 D(ii) <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />MEETING DATE: October 13, 2008 <br />TOPIC: Consider Approving Application for Exempt <br />Permit from Lawful Gambling License (Raffle), St. <br />Joseph Catholic Church <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />St. Joseph Catholic Church has applied for an exempt permit to conduct a raffle at their <br />annual Venison Feed to be held on November 25, 2008. The proceeds from this <br />fundraising event will be used to award college scholarships to members of St. Joseph <br />Catholic Church. Non - profit organizations are allowed, under the State Gambling <br />Statutes, to apply for an exemption from a gambling license if they conduct five (5) or <br />fewer gambling occasions per calendar year. St. Joseph Catholic Church conducts five <br />(5) or less per calendar and, therefore, remains exempt from requiring a gambling <br />license. <br />Minnesota Statutes, Chapter 349, Section 349.166, Subd. 2 does, however, require that <br />the non - profit organizations applying for the exemption permit notify the city that they <br />are applying for the exemption and that local approval be received. <br />The city is allowed to request a 30 day waiting period as part of its approval. However, <br />given the schedule for this event and the requirement to get the permit to the state for <br />review, staff requests that the council approve the request with no waiting period. <br />The application is on file in City Clerk's office. <br />OPTIONS: <br />1. Adopt a motion approving the application for exemption with no waiting period <br />2. Deny the application for exemption. <br />RECOMMENDATION: <br />Option No. 1 <br />• <br />—33— <br />
