• <br />• <br />• <br />AGENDA ITEM 'ID <br />STAFF ORIGINATOR: Julie Bartell, City Clerk <br />DATE: February 23, 2009 <br />TOPIC: Approve Application of Rice Lake Elementary PTO <br />to Conduct Two Excluded Bingo Events <br />VOTE REQUIRED: Simple Majority (3/5 Vote) <br />BACKGROUND: <br />The City has received an application from a representative of the Rice Lake Elementary <br />PTO to conduct two excluded bingo events at the school at 575 Birch Street on March <br />29 and September 18, 2009. <br />Under Minnesota Statutes, Section 349.166, excluded bingo may be conducted by an <br />organization that conducts four or fewer bingo occasions in a calendar year, or in <br />connection with a county fair, the state fair, or a civic celebration if it is not conducted <br />for more than 12 consecutive days. The Rice Lake Elementary PTO organization meets <br />this requirement. The organization also meets the requirements of the Lino Lakes City <br />Code since the physical site where the organization regularly conducts its activities is <br />located within the city. <br />City policy requires a background investigation on the applicant and staff has conducted <br />an investigation and found no reason to deny the application. <br />The application, a certificate of non - profit status and the results of the background <br />check are on file in the city clerk's office. <br />OPTIONS: <br />1. Approve the request to conduct the bingo event. <br />2. Deny the request. <br />RECOMMENDATION: <br />Option No. 1 <br />
