October 7, 2008 <br />Martha Dehaven <br />1612 Birch Street <br />Lino Lakes, Minnesota 55038 <br />RE: Administrative Minor Subdivision Review <br />Dear Applicant: <br />The City of Lino Lakes staff has administratively approved the request for a Minor Subdivision <br />for the property at 1612 Birch Street. This approval is subject to: <br />1. Parcel B must be increased in size to 2.5 acres to meet the accessory structure <br />requirements of the zoning ordinance <br />2. The applicant must record a deed restriction on both parcels that prohibits the sale of <br />either parcel unless combined together. The proposed Declaration of Covenants should <br />be revised as follows: <br />a. Mr. DeHaven's name and interest in the property should be included in the 1s` <br />paragraph. <br />b. Under the declaration an additional clause should be added to state:. <br />"No transfer of either Parcel A or B may be made unless said Parcels are first <br />combined together to create one parcel. This requirement shall not apply to a <br />lending institution who has acquired title as a result of a mortgage foreclosure." <br />c. In the last sentence of the declaration the phrase "grant of easement " should be <br />stricken and replaced with "Declaration ". <br />3.
