DEHAVEN MINOR SUBDIVISION ADMINISTRATIVE REVIEW <br />STAFF ORIGINATOR: Michael Grochala <br />APPROVAL DATE: October 7, 2008 <br />TOPIC: 1612 Birch Street <br />Minor Subdivision <br />BACKGROUND <br />Martha Dehaven submitted a request for a minor subdivision to allow the division of the property <br />currently addressed as 1612 Birch Street, to create 2 parcels under the allowances of Section 3 <br />Subdivision 3.B2.b. This portion of the ordinance allows a 10 acre (minimum) parcel to be <br />divided from a parcel provided that a 1 acre (minimum) parcel and existing home remains <br />provided certain other conditions may be met The biggest condition being that the new parcel <br />must be combined back with the smaller parcel and home for the purpose of sale. <br />ANALYSIS <br />The subject property is zoned Rural, and within this district a minimum 10 acre lot is required. <br />However, an exception to this requirement is allowed when the property is being divided to act <br />as a financial security under such financial agreements as a reverse mortgage. In the case of the <br />latter, a 1 acre parcel with the exiting single family home may remain after a 10 acre minimum <br />parcel is divided from it. <br />Parcel A <br />The second parcel is 11.42 acres in size, thus exceeding the minimum 10 acres. The property is <br />irregular in shape, but does have frontage of 169 feet on Birch Street and 60 feet on Sherman <br />Lake Road <br />Future access to Parcel A will be from the extension of Sherman Lake Road. No access will be <br />permitted from Birch Street (CSAH 34). <br />This property will also need to have deed restrictions recorded that prohibit the sale of the parcel <br />unless combined with Parcel B. <br />Parcel B <br />The property which includes the existing single family dwelling will be 2.04 acres in size, thus <br />meeting the minimum stanrlard of 1 acre. The width and frontage will be 295 feet and the depth <br />will be 302 feet, which both meet the standards of the zoning ordinance The site plan clearly <br />indicates drainage and utility easements of 10 feet on front and rear and 5 feet on the sides. A <br />Deed of Appurtenant Easement was provided granting the easements to the City. The deed will <br />• <br />• <br />
