Lino Lakes - Shoreland and Flood Plain Management <br />4. If the responsible party does not appropriately respond to the Zoning <br />Administrator within the specified period of time, each additional day that lapses shall constitute <br />an additional violation of this chapter and shall be prosecuted accordingly. The Zoning <br />Administrator shall also, upon the lapse of the specified response period, notify the landowner to <br />restore the land to the condition which existed prior to the violation of this chapter. <br />(7) Interpretation. In their interpretation and application, the provisions of this chapter shall <br />be held to be minimum requirements and shall be liberally construed in favor of the governing <br />body and shall not be deemed a limitation or repeal of any other powers granted by state <br />statutes. Where a specific use or performance standard is not specifically referenced in this <br />chapter it shall be prohibited. <br />(8) Abrogation and greater restrictions. It is not intended by this chapter to repeal, abrogate, <br />or impair any existing easements, covenants, or deed restrictions. However, where this chapter <br />imposes greater restrictions, the provisions of this chapter shall prevail. All other ordinances <br />inconsistent with this chapter are hereby repealed to the extent of the inconsistency only. <br />(9) Warning and disclaimer of liability. This chapter does not imply that areas outside of the <br />Flood Plain Overlay District or land uses permitted within these districts will be free from flooding <br />or flood damages. The chapter does not create liability on the part of the City of Lino Lakes or its <br />officers or employees for any flood damage that may result from reliance on this chapter or any <br />administrative decision lawfully made under it. <br />(10) Severability. If any section, clause, provision, or portion of this chapter is adjudged <br />unconstitutional or invalid by a court of competent jurisdiction, the remainder of this chapter shall <br />not be affected thereby. <br />(Ord. 12 -95, passed 7 -25 -1995) <br />§ 1103.03 DEFINITIONS. <br />For the purpose of this chapter, the following definitions shall apply unless the context clearly <br />indicates or requires a different meaning. <br />ACCESSORY USE OR STRUCTURE. A use or structure on the same lot with, and of a <br />nature customarily incidental and subordinate to, the principal use or structure. <br />BASEMENT. Any area of a structure, including crawl spaces, having its floor or base <br />subgrade on all 4 sides, regardless of the depth of excavation below ground level. <br />CONDITIONAL USE. A land use or development that may not be appropriate generally <br />within a certain district but may be allowed in that district with appropriate restrictions, conditions <br />or limitations as imposed by the City Council. <br />• <br />1 <br />
