Dougherty <br />DATE: April 10,2009 <br />RE: wry oiAttomey Opinion <br />In accordance with your request, the following summarizes the key components of our written opinion <br />dated April 6,2009, regarding the investigation of Charter Commission iviatexiat• <br />• The Clymer Commission has limited powers which are emumented in Chapter 410 of the <br />Minnesota Statutes. <br />• The and Commission may only contract for (1) the employtnent of an attorney and Other ' <br />perrammel to assist in framing a charter and any Mite:id/Tient or revision and (2) the cost of <br />ing the charter and any amendment or revision. <br />• The Cormramtion does not have any express or implied powei <br />the preparation dillies, lawn signs and/or Web sites . <br />preiParo or centred fOr <br />• TheCharterrenzussion has no expsress or milked power tO niannwand control public property, <br />rdiio employees ot city business. <br />• lvfninesota Statutes limit the City of lino Lakes' payment of charier cenunissjen expenses oest <br />of attorney and other personnel sitting in the amendment or revhdon of the chatter and cost or <br />Printing) tO S1,500.00 per year <br />• The City of Lino Lakes may -exceed the $1,500.00 per year limit if the-Council deems the excess <br />payment (cost of attorney and other personnel assisting the amendment or revision of the charter <br />and cost &priming) to be necessary. <br />• When directed by the Charter Commission for payment, the payment made by the City of Lino. <br />Lakes shall be paid directly to the vendor (attorney or printer). <br />cc: Al Rolek, Finance Director <br />
