COUNCIL MINUTES May 26, 2009 <br />DRAFT <br />46 <br />47 FINANCE DEPARTMENT REPORT, AL ROLEK <br />48 <br />49 There was no report from the Finance Department. <br />50 <br />51 ADMINISTRATION DEPARTMENT REPORT, DAN TESCH <br />52 <br />53 3A) Consideration of Resolution No. 09-32, providing for a finding of violation of the <br />54 City Code and imposing penalties against Jason's Bobby & Steve's Auto World <br />55 <br />56 City Clerk Bartell reported that previous to this evening's meeting, the council held a liquor <br />57 compliance hearing to review the Police Department's report and recommendation relative to <br />58 beer code compliance violation. Jason's Bobby & Steve's Auto World at 7090 21A Av was <br />59 found to have violated the city's regulations and a penalty of $1,500 and a ten -day suspension <br />60 (stayed for one year without another violation) was recommended by both the Police Department <br />61 and the City Council. Based on that recommendation, staff is presenting Resolution No. 09 -32 <br />62 imposing said penalty. <br />63 <br />64 Jason Snyder, owner (in partnership) of Jason's Bobby & Steve's Auto World. Mr. Snyder told <br />65 the council that that he understands that they are reluctant to waiver from the Best Practices Grid <br />66 however he believes that is a mistake. Every situation is different and the seriousness of the <br />67 situation is very much recognized by him He is taking steps at the business to avoid having this <br />68 happen again. He requests special consideration on the fine; that the fine be stayed, or a <br />69 reduction of the amount or extra time to pay it. There is not a lot of money in the sale of 3.2 beer <br />70 at his establishment. The council discussed but took no action on the time frame under which the <br />71 fine must be paid. <br />72 <br />73 The council discussed the importance of being consistent in handling these violations. It is <br />74 important to stick with the Best Practices Grid. <br />75 <br />76 Council Member O'Donnell moved to approve Resolution No. 09 -32 as presented. Council <br />77 Member Gallup seconded the motion. Motion carried. <br />78 <br />79 3B) Consideration of contract with Personnel Decision Inc. for City Administrator <br />80 search. <br />81 <br />82 Administrator Tesch reported that the council is considering a contract providing for the services <br />83 of Mr. Harry Brull to assist in the city's search and hiring of a new city administrator. <br />84 <br />85 Council Member Gallup moved to approve the contract with Personnel Decision Inc. as <br />86 presented.
