1s` Reading: <br />Publication: <br />2nd Reading: <br />Effective: <br />Council Member <br />moved for adoption of the following ordinance- <br />CITY OF LINO LAKES <br />ORDINANCE NO. 05-09 <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE TO REMOVE 1 H <br />SIX -MONTH MAXIMUM ON EXTENSIONS FOR SUBMITTING'1'HE FINAL <br />DEVELOPMENT PLAN FOR A PLANNED UNIT DEVELOPMENT <br />Section 1 Findings <br />1. Section 2, Subd. 10 of the Lino Lakes Zoning Ordinance includes the requirements for a <br />Planned Unit Development. <br />2. Section 2, Subd. 10.F.8.g. includes the time frame requirements for submittal of the final plan <br />for a Planned Unit Development. This requires that the final plan be submitted within one- <br />year of approval of the development stage plan. It also allows an extension for not more than <br />six months. <br />3. Section 2, Subdivision l of the Zoning Ordinance requires that the City must consider <br />possible adverse effects of a proposed amendment to the Zoning Ordinance and judgment <br />shall be based upon, but not limited to, the following factors: <br />1. The proposed action has been considered in relation to the specific policies and <br />provisions of and has been found to be consistent with the official City Comprehensive <br />Plan. This amendment does not involve a rezoning of a property, but the removal of a <br />time extension restriction. The restriction applies only to planned unit developments. <br />Other platting projects, with timelines governed locally by the subdivision and platting <br />chapter of the city code, do not have such a restriction. <br />2. The proposed use is or will be compatible with present and future land uses of the area. <br />This removal of a time extension restriction will have no effect on the compatibility of <br />any project with its surrounding uses. <br />3. The proposed use conforms with all performance standards contained herein. This <br />removal of a time extension restriction is an amendment of a performance standard. No <br />compliance with other standards will be affected. <br />4. The proposed use can be accommodated with existing public services and will not <br />overburden the City's service capacity. <br />_77_ <br />• <br />• <br />• <br />
