MEMORANDUM <br />To: Mayor and Council <br />From: Mary Divine <br />Date: August 6, 2009 <br />Re: EDAC recommendation regarding amending GB and LB Zoning <br />Districts to allow religious, public and educational uses. <br />At the request of a council member, this proposed ordinance was brought to EDAC for its <br />consideration at its Thursday, August 6 meeting. EDAC members agreed that the <br />enactment of federal law that requires like uses to be treated equally was enough reason <br />to adopt the amendment to the ordinance. Beyond that members acknowledged that this <br />amendment would allow uses that could remove properties from the commercial tax <br />roles. However, such uses were reasonable within areas that had infrastructure to support <br />them and they attracted people who would use city amenities such as restaurants and <br />shopping. EDAC recommended unanimously to support the proposed amendment to the <br />GB and LB Zoning Districts. <br />A question arose regarding the need to include educational and public uses within GB and <br />LB Zoning Districts. EDAC requested staff opinion regarding the elimination of those <br />uses which are also not taxed from the amendment. <br />Staff' s recommendation remains that because these uses are similar in function and often <br />difficult to separate, they should remain within the same category in the zoning <br />ordinance. <br />
