➢ If the ordinance is enacted, there is a minimum 90 -day delay before the <br />amendment becomes effective during which a 60 -day period is allowed for <br />submission of a registered voter petition for referendum (thus commencing a new <br />process for ballot consideration). <br />Ordinance Text: The city received two legal opinions relative to the text of the <br />proposed amendment that question the clarity of the wording. Accordingly the council <br />directed the city attorney to redraft the language for clarity for consideration by the <br />charter commission. The commission rejected the new language developed by the city <br />attorney and chose to keep the wording as they originally proposed. The ordinance <br />containing the text of the amendment is attached. <br />Implementation Questions: The council has asked for more information on both the <br />cost and logistics of implementing the amendment. There would be additional <br />unbudgeted costs to the city in televising all council meetings. The cost for video <br />technician services is $12 per hour (with a 3 hour minimum). An estimate for additional <br />meetings requiring televising would be the 12 regular work sessions plus any special <br />work sessions (there were approximately 6 special work sessions not held on regular <br />council days in 2008 and 9 already in 2009). I did not include special council meetings in <br />the estimate since the amendment identifies only regular council meetings. <br />The city council chamber is currently the only meeting room ready for use in televising <br />meetings. Since council work sessions are held on the same evening each month as the <br />Park and Recreation Board, those board meetings would have to be relocated and not <br />televised or additional facilities developed that are television ready. There could be other <br />room conflicts that arise with special meetings. <br />Requested Council Direction <br />This report is provided to update the council on the charter amendment previous to the <br />public hearing scheduled for September 8. <br />Attachment(s) <br />1.
