COUNCIL MINUTES August 10, 2009 <br />DRAFT <br />135 with aggressive driving issues. Staff is recommending that this agreement be executed to <br />136 continue city participation in the program. <br />137 <br />138 Council Member Gallup moved to approve Resolution No. 09 -58 as presented. Council <br />139 Member Stoltz seconded the motion. Motion carried. <br />140 <br />141 4C. Resolution No. 09 -59, Authorizing Execution of Agreement with the Department of <br />142 Public Safety for the Safe & Sober Communities Grant — Police Chief Pecchia reported that <br />143 the city has participated in this safe and sober program for the past ten years. This is another <br />144 program that improves safety levels on the city's roadways. Staff is recommending that an <br />145 agreement be executed to continue the city's participation in the program. <br />146 <br />147 Council Member Reinert moved to approve Resolution No. 09 -59 as presented. Council <br />148 Member Gallup seconded the motion. Motion carried. <br />149 <br />150 PUBLIC SERVICES DEPARTMENT REPORT, RICK DEGARDNER <br />151 <br />152 There was no report from the Public Services Department. <br />153 <br />154 COMMUNITY DEVELOPMENT REPORT, MICHAEL GROCHALA <br />155 <br />156 6Ai. Second reading of Ordinance No. 04-09: Zoning Ordinance Amendment to Allow <br />157 Public, Educational, and Religious Buildings as Conditional Uses in the General Business <br />158 and Limited Business Zoning Districts, and Amending City Code so that Required <br />159 Distance for Liquor License shall not apply if School or Church is in Limited Business or <br />160 General Business Zoning District — City Planner Smyser reported that the council approved <br />161 first reading of this ordinance at the July 27, 2009 council meeting. The ordinance would <br />162 amend the zoning regulations for general business and limited business zoning districts to allow <br />163 religiou/public educational uses and in addition would amend the liquor code to exempt the <br />164 required distance for liquor licenses within those previously mentioned zoning districts. A <br />165 resolution authorizing summary publication of the ordinance is also presented for council <br />166 consideration. <br />167 <br />168 The city's Economic Development Advisory Committee had submitted a letter in support of the <br />169 changes. The city's Planning and Zoning Board unanimously approved these amendments. <br />170 <br />171 A council member suggested that while the concept of the change makes sense, he still has <br />172 concerns about this not fitting in Lino Lakes — it seems more inner city. Would it be possible to <br />173 amend this so that it would be for free- standing buildings only? He doesn't have a problem with <br />174 the specific situation involved with the former VFW building. <br />175 <br />176 Attorney Langel responded that zoning by nature of structure isn't necessarily appropriate. The <br />177 larger concern is the federal law that is involved and the need to have a "compelling" reason to <br />178 not comply with that law.
