STAFF ORIGINATOR: <br />MEETING DATE: <br />TOPIC: <br />VOTE REQUIRED: <br />BACKGROUND <br />AGENDA ITEM 1A <br />Julie Bartell, City Clerk <br />September 8, 2009 <br />Public Hearing and 1st Reading of Ordinance <br />No. 06 -09, Amending Section 3.01 of the Home Rule <br />Charter to require that council meetings be televised <br />3/5 <br />On July 13, 2009 the Lino Lakes Charter Commission submitted a charter amendment <br />and indicated that the amendment should be considered a proposal under Minnesota <br />Statutes, Section 410.12, Subd. 7, Amendment by ordinance. The proposal was <br />distributed to the council at their work session that evening, thus commencing the <br />statute defined schedule for consideration of this type of amendment. <br />Schedule: The following outlines what has transpired to this point and the schedule <br />that lies ahead; the schedule is based on statute requirements as well as the city <br />charter. <br />D The city was required to publish a public hearing notice on the amendment prior <br />to August 13). Based on council direction, a notice appeared in the city's official <br />newspaper on August 11. <br />> The public hearing is required to be held on or between the dates of August 25 <br />and September 11. The council set the public hearing for Tuesday, September <br />8. <br />> Within one month of the public hearing (by October 8) the council must vote on <br />the proposed charter amendment ordinance (regular council meetings during <br />that period are on September 14th and 28th). Section 3.05 of the City Charter <br />establishes certain procedures on adoption of ordinances including a <br />requirement for two readings at least 14 days apart. The city attorney has <br />advised that the public hearing could be considered the first reading and that a <br />simple majority vote could approve the first reading. Since the second reading <br />must occur at least 14 days later, the September 14th council meeting is too <br />soon. Therefore, if first reading is approved, the ordinance will appear on the <br />September 28 council meeting agenda. Statute states that the ordinance is <br />enacted if it receives an affirmative vote of all members of the council. <br />> If the ordinance is enacted, there is a minimum 90 -day delay before the <br />amendment becomes effective during which a 60 -day period is allowed for <br />submission of a registered voter petition for referendum (thus commencing a <br />new process for ballot consideration). <br />
