• The city clerk inserted all changes into the draft code document for review by the <br />council. The council has overviewed the code, section by section, with staff <br />explaining any changes that were seen as substantive and with the council <br />incorporating changes as they deemed appropriate. <br />Note that the update project does not include the zoning section of the code at this time. <br />Those regulations will be updated as part of implementation of the comprehensive plan. <br />Requested Council Direction <br />The process of staff and council review has concluded, changes and updates have been <br />inserted and the code has been reprinted. Staff is prepared to bring forward the new code <br />in its entirety for council approval. <br />There are some specific requirements for passage of a new city code. Please note the <br />following list that outlines those requirements and proposes a schedule for council <br />consideration as well as installation of the new code. <br />1. The City Charter, Section 3.11, directs the council to keep the city code up to date <br />with additions and deletions as it deems necessary and this is the purpose of the code <br />update project. The charter also allows the incorporation of new provisions with proper <br />notice in the newspaper. If the council directs that the recodification project should <br />proceed, staff will proceed to publish the appropriate notices in the Quad Press on <br />October 13 and October 20. <br />2. The code must be adopted by ordinance and the city charter requires two readings <br />at least fourteen days apart for passage of ordinances. Staff proposes that an ordinance <br />enacting the city code be brought forward at the council meeting on November 9 and <br />November 23. <br />3. A public hearing is required and staff proposes that it be held at the 1st reading on <br />November 9. <br />4. Adoption of any changes to tobacco regulations require written notice mailed at <br />least 30 days before the hearing to each person licensed to sell tobacco products. If the <br />schedule for consideration of the new code is found to be acceptable to the council at this <br />work session, the city clerk will mail these notices as soon as possible. <br />5. The city's fee schedule would be removed from the text of the code of ordinances <br />but would be updated and adopted annually as an appendix to the code. The fee schedule <br />requires a public hearing and staff proposes that the hearing for the 2011 city fee <br />schedule ordinance be held in conjunction with the hearing on adoption of the new code. <br />If the council authorizes that this process should proceed, staff proposes to provide for <br />public review at the hearing a copy of the new code that shows all the changes (underline <br />and strike out) that are included in adopting the new code. <br />2 <br />• <br />• <br />• <br />
