Council Member introduced the following resolution and moved its adoption: <br />CITY OF LINO LAKES <br />RESOLUTION NO. 09-104 <br />RESOLUTION APPROVING CHANGE ORDER NO. 17 <br />LAKE DRIVE!I35W IMPROVEMENT PROJECT <br />WHEREAS, pursuant to the resolution of the City Council adopted May 14, 2007, the <br />City awarded the construction contract for the Lake Drive /I -35W Improvement Project to <br />Lunda Construction Company, and <br />WHEREAS, EJM Pipe Service began to install a new strom pipe jacked under 1 -35W to <br />perpetuate the drainage around the new bridge no. 02817; and <br />WHEREAS, said work was temporarily suspended by the project engineer pending <br />approval of the pipe jacking material by the design engineer; and <br />WHEREAS, EJM Pipe Service has submitted a claim requesting payment for costs <br />associated with the delay; and <br />WHEREAS, the project engineer has determined that the contractor is entitled to costs <br />resulting from the delay. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />LINO LAKES, MINNESOTA: <br />1. Change Order No.17, is hereby approved in the amount of $1,202.34. <br />John J. Bergeson, Mayor <br />Julianne Bartell, City Clerk <br />Adopted by the Lino Lakes City Council this 23`d day of November, 2009. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member and upon vote being taken thereon, the following voted in favor <br />thereof: <br />The following voted against same: <br />Whereupon said resolution was declared duly passed and adopted. <br />• <br />• <br />• <br />
