The city has published and advertised as much as possible in the short period of time
allowed, a Notice of Vacancy, and that same notice will be posted on the city website and at all
polling places. If voters have questions about the vacancy and the process to fill it, they will be
referred to the notice or city hall. To avoid confusion election judges will not answer questions
but, if necessary, will instruct voters to vote for two as per the printed ballot If a voter were to
vote for more than two, the voting machine will not accept the ballot and the voter will be given
an opportunity to revote or to override the machine whereby the votes for that race only would
not be counted.

City Attorney Langel opined that the winner of the third seat (the third highest vote getter for city
council) would be filling a vacancy and therefore could take office as soon as possible. That
would generally be after the election is canvassed or later as the council determines.

The council concurred that the vacant position should be filled as soon as possible.

The meeting was adjoumed at 5:42 p.m.

These minutes were considered, corrected and approved at the regular Council meeting held on
November 23, 2009.

City Clerk, Julianne Bartell John Bergeson, Mayor
