• <br />• <br />MEMORANDUM <br />March 6, 2002 <br />to: City Council <br />from: Jeff Smyser <br />subject: Petition for EAW: Pheasant Hills 12th Addition <br />We have received a petition requesting the preparation of an Environmental Assessment <br />Worksheet (EAW) for the Pheasant Hills 12th Addition project. The petitioners submitted their <br />petition to the Minnesota Environmental Quality Board (EQB), which forwarded it to the City of <br />Lino Lakes. This process complies with state requirements. <br />The petition requests that the EQB act as the responsible governmental unit for the EAW. In <br />accordance with the rules, the EQB decides which governmental unit has the greatest <br />responsibility for supervising or approving the project as a whole. In this case, it is the City of <br />Lino Lakes, and so the EQB forwarded the petition to us. <br />No final decision can be made on the project until: a) the City decides no EAW is needed, or; b) <br />the City decides an EAW is needed, and afterward decides no environmental impact statement is <br />needed. <br />(.0 <br />The City must decide if an EAW should be prepared. If, because of the nature or location of the <br />project, it may have the potential for significant environmental effects, an EAW should be <br />prepared. If the City does not think there may be the potential for significant environmental <br />effects, it should deny the petition. <br />The City has 30 working days to make this decision: We received the petition February 28. This <br />gives us until April 11. This period includes three City Council meetings: March 11, March 25, <br />and April 8. <br />The decision on preparing an EAW must include written findings. We typically would include <br />findings in a City Council resolution stating the Council's decision.
