• <br />• <br />STAFF ORIGINATOR: <br />P & Z MEETING DATE: <br />TOPIC: <br />ACTION REQUIRED: <br />BACKGROUND <br />AGENDA ITEM 5A <br />Tanda Gretz <br />February 12, 2003 <br />Zoning Ordinance Amendment & Conditional <br />Use Permit to Allow a Tree Service Business to <br />Operate in a Rural Zone, at 908 -1/2 Maple Street <br />Charles Pfingsten ( "Charlie's Tree Service ") <br />3/5 vote <br />This application was heard at the January 8th meeting of the Planning & Zoning Board. <br />Background, history and analysis was given at that time (see report dated January 8, <br />2003). At the January 8th meeting a number of residents of the Maple Street <br />neighborhood spoke about their concerns for the proposed use. The residents voiced a <br />number of concerns about past practices on the site, including noise, excess traffic, <br />late /irregular hours, and parking issues. Residents stated they didn't want such <br />conditions to reoccur. <br />Board members stated that they would not support a rezoning of the property to any kind <br />of a commercial or industrial use, but felt that the applicant and residents might be able to <br />come to some agreement/acceptance of use for the site if they could sit down and discuss <br />the issue with one another. Board members stated that since the site had a conditional <br />use permit for an auto body shop, another such shop could potentially move into the site <br />in the future. Board members advised residents that the applicant's proposed use was <br />lower in intensity than that of another auto body shop, and so it might be in the best <br />interest of the neighborhood to support such a proposed use. <br />
