• <br />• <br />• <br />AGENDA ITEM 5A <br />STAFF ORIGINATOR: Bob Kirmis (NAC) <br />P AND Z MEETING DATE: March 12, 2003 <br />TOPIC: Bruggeman Properties - Rezoning, <br />Preliminary Plat, Site & Building Plan <br />Review and CUP (for accessory drive - <br />through) <br />BACKGROUND <br />Bruggeman Properties has requested preliminary plat approval to allow a three lot, <br />commercial subdivision on property located south of Birch Street and east of Hodgson <br />Road. <br />The development site overlays 33.3 acres of land, 24.8 acres of which is to be reserved <br />for future medium density development (to be developed after the present residential <br />development moratorium is lifted) and lies within the shoreland overlay district of <br />Baldwin Lake. <br />To accommodate the development proposal, the following approvals are necessary: <br />1. Rezoning of a portion of the property from R, Medium Density Residential to GB, <br />General Business /PDO (to allow private streets and multiple buildings on a single <br />lot) <br />2. Preliminary Plat <br />3. Site and Building Plan for a 12,160 square foot retail center <br />4. CUP for an accessory drive - through facility (accessory to the retail center) <br />The Planning & Zoning Board tabled the request at the February 12th meeting, as a <br />number of issues had yet to been addressed. Specifically, staff had stated that they <br />"cannot recommend approval until the following items have been addressed: (items 1- <br />19)." <br />RECOMMENDATION <br />Staff is continuing to work with the developer on these issues and recommends tabling <br />this item again. <br />
