Planning & Zoning Board <br />July 9, 2003 <br />Page 10 <br />Kevin Murphy, 583 Lois Lane, clarified there was nothing wrong with his septic tank <br />right now, but it was frozen solid last spring like everyone else. He stated by delaying <br />this, it was not a hardship for him. <br />Mr. Grochala stated he believed there were non - conforming and failing septic systems in <br />this area. <br />Mr. Hyden made a MOTION to close the public hearing at 10:00 p.m. and was supported <br />by Mr. Tralle. Motion carried 4 -0. <br />Mr. Corson made a MOTION to approve the Comprehensive Plan Amendment changing <br />land use from Low Density Unsewered to Low Density Sewered Residential and obtain <br />additional MUSA Reserve and Allocate MUSA and was supported by Mr. Tralle. <br />Motion carried 4 -0. <br />Mr. Corson made a MOTION to approve the rezone from Rural to R -1 and was supported <br />by Mr. Tralle. Motion carried 4 -0. <br />Mr. Corson made a MOTION to approved the Preliminary Plat with the twelve (12) <br />conditions as noted in staff's report, and was supported by Mr. Hyden. Motion carried 4- <br />0. <br />Mr. Corson made a MOTION to approve the variance for 132 feet lot depth, and was <br />supported by Ms. Lane. Motion carried 4 -0. <br />D. CONTINUED PUBLIC HEARING, Discount Tire, 633 Apollo Drive, Site <br />Plan Review and CUP <br />Vice Chair Rafferty reopened the public hearing at 10:05 p.m. <br />Staff reviewed their July 9, 2003 report and recommended approval of the proposed CUP <br />with the nine conditions as noted in staff's report. He indicated he was adding a tenth <br />condition that the trash enclosure be in compliance with the Zoning Ordinance. He <br />indicated staff was recommending approval of this development with the ten conditions. <br />Mr. Tralle asked if the frontage road was private and if it was maintained by the <br />development. Mr. Grochala replied it was a private road maintained by the development. <br />Mr. Tralle inquired about the landscaping on the boulevard and who was responsible for <br />it. Mr. Grochala replied each development was responsible for the boulevard <br />landscaping, but the City would requirement coordination of the landscaping by the <br />developments. <br />Vice Chair Rafferty invited applicant to make comment. <br />Bill Wendell, Discount Tire, 8000 West 78th Street, Edina, stated Lino Lakes was one of <br />the first areas he drove and he noted there was a Target and Kohls in the City and they <br />were associated with Target and Kohls in other states, and therefore he had an interest in <br />• <br />• <br />
