A <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: January 14, 2004 <br />TOPIC: CONTINUEDPUBLIC HEARING: Preliminary Plat <br />and Conditional Use Permit For A Church In the Rural Zoning <br />District <br />Eagle Brook Church <br />BACKGROUND <br />The P & Z opened the public hearing on the conditional use permit application at the November <br />meeting. That public hearing was continued to the December meeting. A number of issues <br />remained unanswered, one of which was the existing house on the site. We received an <br />application to plat the property to create two lots, one for the church and one for the house. The <br />public hearing on the plat was opened at the December meeting. We can combine the two public <br />hearings into one. The hearing was continued to the January 2004 meeting. <br />The November staff report also called for additional information on the stormwater design and <br />roadway improvements. Public comments at the hearing resulted in requests for further <br />information on several specific issues. The December staff report updated information in the <br />previous report. We received new plans and information on December 18. <br />ANALYSIS <br />Issues that were not resolved after the December meeting are listed and discussed below: <br />• A revised preliminary plat was needed indicating the locations in Lot 2 of the existing well, <br />the existing septic system, and a site for a secondary drainfield. All must meet the required <br />setback and separation distances. A soils analysis is needed for the secondary drainfield site. <br />We received a revised set of plans on December 18. The plans indicate the locations of the <br />existing well and drainfield as well as a secondary drainfield site. Setbacks from lot lines must <br />be 10 for the drainfields. The drainfields must be 100' from the well. The plan meets these <br />requirements. The soils analysis supports the designed mound system. <br />• Typical lot line easements must be included on the plat. The lot line easements have been <br />added to the plat and grading plan. Easements are shown over ponds, swales, and wetlands. <br />These must be included on the final plat, as normally required. <br />• The traffic analysis must be revised to address service times on Saturdays and weekdays. <br />
