• <br />CITY OF LINO LAKES <br />RESOLUION NO. 03- <br />RESOLUTION APPROVING AN AMENDMENT OF A CONDITIONAL USE <br />PERMIT, VARIANCES FOR SETBACKS, AND THE ALLOCATION OF 2.24 <br />ACRES OF COMMERCI_8,1, MUSA FOR THE CIRCLE -LEX VFW SITE, 7868 <br />LAKE DRIVE <br />WHEREAS,Ahe City has received an application for an uncndment of a conditional use <br />permit to allow a the construction of a new building for the Circle -Lex VFW, a private <br />chub: and <br />WHEREAS, the subject property currently is zoned GB General Business; and <br />WHEREAS, private clubs is a conditional use in the GB zone and the VFW has an <br />existing, conditional use permit; and <br />WHEREAS, the legal description of the property is: <br />(see ATTACHMENT A) <br />and <br />WHEREAS. the site currently is not within the existing boundaries of the Metropolitan <br />Urban Service Area (MUSA) but the requested MUSA allocation is consistent with the <br />comprehensive plan and growth management policy because: <br />• the site is guided for commercial use :in the comprehensive plan, <br />• the site is in a Stage 1 growth area . • <br />• the City has y11."S.:\ reserve available for commercial development <br />the proposed development is not premature <br />and <br />WHEREAS. at thcir meeting on , 2003, the Planning & Zoning Board held.a <br />public hearing and recommended approval subject to conditions: <br />NOW. TIlERETORE, BE IT RESOLVED that the Lino Lake; City Council hereby <br />approves the allocation of 2.24 acres of commercial MUSA for the site, and; <br />BE IT FtTRTHER RESOLVED that the Lino Lakes City Council hereby approves the <br />amendment to th.t conditional use permit, with the following conditions: • <br />1. paste in the conditions agreed upon by city council <br />
