• <br />Fox Den Acres <br />page 5 <br />Though this easement vacation technically is not a P & Z item (the City Council holds a public <br />hearing on vacations), it is an issue now because of the additional area proposed for development <br />outside the existing MUSA and growth area. The vacation of the flowage easement would be <br />necessary if the additional growth area is approved. <br />The City looks carefully at requests to vacate such easements. We require that the applicant <br />prove that the easement is not necessary and that the vacation will have no negative effect. The <br />only reason to vacate the portion of the easement on the east edge of the project would be to <br />provide for the additional lots outside the growth area and MUSA. On the south, the lots within <br />the growth area can be created with the easement. It does not appear that the vacation is <br />justified. <br />ENVIRONMENTAL BOARD <br />The Environmental Board reviewed this application on March 31St. Recommendations are <br />attached. <br />OPTIONS. <br />1. Approve the project, including the three elements: <br />a. Comprehensive Plan Amendment <br />b. Allocation of MUSA Reserve <br />c. Preliminary Plat <br />2. Continue public hearing and return to staff with direction. <br />RECOMMENDATION <br />Option 2 <br />• The proposed plat extends beyond the stage 1 (pre -2010) growth area, the MUSA, the Low <br />Density Sewered Residential land use area, and the R -1 zone. It also would require the <br />vacation of a ponding and flowage easement. The proposer requests amendments to the <br />comprehensive plan and zoning map to accommodate the extra 3 -4 acres of development. <br />There is no clear justification other than to increase developable area. <br />• We do not yet know if water service is adequate. <br />• The traffic study is based on outdated road information and should be revised. <br />• A ghost plat must be created for property north of the proposed northern road stub. <br />
