D <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: May 12, 2004 <br />TOPIC: Final Plat <br />Justin's Preserve <br />BACKGROUND <br />The City Council approved the preliminary plat for Justin's Preserve on March 8, 2004. The <br />applicants have requested approval of the final plat. <br />The submitted final plat conforms to the approved preliminary plat. There is no development <br />agreement needed for this project as there are no improvements requiring City involvement. The <br />applicant is assembling information to fulfill the conditions of approval as discussed below. <br />1. Lot 1 shall connect to city sanitary sewer and water. <br />This will happen when the new lot draws a building permit. <br />2. Issues discussed in the City Engineer review memo must be addressed to his satisfaction. <br />Several issues remain to be resolved including approval by the Rice Creek Watershed <br />District and additional engineering data regarding high water level of the wetlands. <br />3. Park dedication of $1,665 shall be paid. <br />This has been paid. <br />4. Prior to approval of the final plat by City Council, the applicant shall submit proof that the <br />powerline easement has been confined. <br />We received a copy of the partial release of easement. This document should be recorded <br />with the final plat by the applicant. <br />5. Approval by the Rice Creek Watershed District must be obtained prior to final plat approval <br />by the City Council. <br />We have not received word that the RCWD has approved the revised version of the plat. <br />Additional title information is pending as well. The inclusion in the plat of the neighboring <br />property requires title information for that property as well. <br />
