• <br />• <br />Planning & Zoning Board <br />May 12, 2004 <br />Page 7 <br />Mr. Black stated he would like a decision made at tonight's meeting and make a decision <br />with staff as to whether he would carry the application forward to the City Council. <br />Mr. Root stated challenging design issues were what many of the plans presented to the <br />City were. He indicated the access issue was a big problem with this development. He <br />agreed that a northern access to Old Birch would also be a problem. He stated he could <br />not support this as it was currently presented to him. <br />Mr. Rafferty made a MOTION to recommend denying the Comprehensive Plan <br />Amendment and was supported by Mr. Pogalz. Motion carried 5 -0. <br />Mr. Root made a MOTION to recommend denying the MUSA reserve Root and was <br />supported by Mr. Tralle. Motion carried 5 -0. <br />Mr. Hyden made a MOTION to recommend denying the Preliminary Plat and was <br />supported by Mr. Tralle. Motion carried 5 -0. <br />D. Final Plat for Justin's Preserve, Sue Carpenter, 171 White Pine Road <br />Staff stated the City Council had approved the preliminary plat for Justin's Preserve on <br />March 8, 2004. The applicants have requested approval of the final plat. He noted the <br />submitted final plat conforms to the approved preliminary plat. There is no development <br />agreement for this project as there are no improvements requiring City involvement. He <br />recommended approval based on the following conditions as summarized in staff's May <br />12, 2004 report: <br />1. Lot 1 shall connect to city sanitary sewer and water. <br />2. Issues discussed in the City Engineer review memo must be addressed to his <br />satisfaction. <br />3. Park dedication of $1,665 shall be paid. <br />4. Prior to approval of the final plat by the City Council, the applicant shall submit <br />proof that the powerline easement has been confined. <br />5. Approval by the Rice Creek Watershed District must be obtained prior to final <br />plat approval by the City Council. <br />Mr. Rafferty left the meeting at 7:56 p.m. <br />Mr. Pogalz made a MOTION to recommend approval of the Final Plat for Justin's <br />Preserve, Sue Carpenter, 171 White Pine Road subject to the conditions as noted in <br />staff's May 12, 2004 report and was supported by Mr. Hyden. Motion carried 4 -0 (Mr. <br />Rafferty was absent for the vote). <br />E. Final Plat for Eagle Brook Addition <br />Staff stated the City Council had approved the preliminary plat for Eagle Brook Addition <br />on March 22, 2004 with Resolution 04 -17. The Church has now submitted a final plat. <br />The final plat conforms with the approved preliminary plat. The City Attorney has <br />reviewed the title commitment.
