Storage shall not include material considered hazardous under <br />Federal or State Environmental Law. <br />• <br />• <br />Staff Opinion <br />The issue of parking trucks outdoors in commercial and industrial areas and the <br />applicability of exterior storage requirements has been raised several times in the past. <br />The 2003 Zoning Ordinance update did provide some additional clarification to the issue. <br />However, the discussion and modifications made related primarily to semi - trucks and <br />trailers. <br />While the definition of exterior storage includes "vehicles" the exterior storage <br />requirements in Section 3., Subdivision 4.P.2 states in part that "Semi- trailers connected <br />to semi - tractors queuing for loading or unloading shall be considered truck parking and <br />be exempt from the outdoor storage conditional use permit ". <br />Therefore it is our opinion that the proposed Schwan's delivery trucks would not be <br />considered exterior storage. <br />However, any site development for the proposed use would need to comply with <br />screening requirements. Schwan's has indicated they are working on a site design that <br />screens the parking area from I -35W. <br />The City's Economic Development Advisory Committee (EDAC) discussed the issue at <br />its July 1, 2004 meeting and recommended support for the Schwan's project in the <br />Marshan Lake Industrial Park with proper screening. <br />Staff would like comments from the board on this issue. We anticipate the need to <br />review and revise the ordinance language to avoid any further ambiguity. <br />Attachment <br />1.
