• <br />RLS, North Road Area <br />page 3 <br />Land Owners' Agreement on the RLS: At the time of the preparation of this report, <br />there is some question about the legal format for the landowners' agreement for approval <br />of the RLS reconfiguration. On a plat, the signatures of all with interest in the property <br />must sign the plat or sign a separate consent to plat document. The RLS does not have a <br />signature page and the RLS is being proposed by the City of Circle Pines, which is not <br />the property owner of the land in question. The situation is different from a typical plat. <br />Our city attorney is pursuing this question and we expect to have information for the <br />public hearing. <br />Northern Right of Way Line: Several of the attached drawings show the northem right <br />of way line running in a southwest to northeast diagonal across the westernmost area of <br />the RLS. You can see that the line appears in different places on different drawings. We <br />have asked to have this clarified. The City of Lino Lakes owns Lot 12 (Tract A). <br />Needed Right of Way: It is possible that Anoka County may in the future consider <br />vacating areas of the existing right of way, which would result in more buildable land on <br />some lots such as Tracts A, L, M, N, and O. We have asked Circle Pines to confer with <br />Anoka County Highway Dept. about the area needed for right of way. Maybe this area <br />can be delineated with separate tracts to facilitate future vacations. <br />• Because these issues call for additional information, staff is not ready to recommend <br />approval of the RLS. <br />RECOMMENDATION <br />Open public hearing, take comments, continue public hearing to March 9 meeting <br />• <br />
