Planning & Zoning Board <br />April 13, 2005 <br />Page 20 <br />Dan Cookee, 7290 Stagecoach Trail, asked if the trail had been abandoned by the City. <br />Mr. Smyser replied there never was an easement. <br />Mr. Houchins responded there was an exiting City easement. <br />Mr. Cooke stated it was his understanding the trail was behind their home was the City's <br />and some had put down Class 5. He asked if the City had an easement behind their <br />property. Mr. Smyser replied documents showed that the City had chosen not to run the <br />trail there, but he was unsure if the City had an easement behind his property, but he <br />would look into that possibility. <br />Mr. Cooke asked if he could remove the Class 5. Mr. Smyser replied he did not realize <br />there was Class 5 there and he would need to look into this. <br />Mr. Cooke noted this Class 5 was put in at the same time as the asphalt path was put in <br />behind Lots 3 and 4. He stated he was on Lot 1 and Mr. Houchins was on Lot 2 and the <br />Class 5 ran behind Lots 1 and 2. <br />Mr. Cooke stated he hoped the trail would go through and it made sense for the trail to <br />continue around the lake. He proposed the trail continue through this development, and <br />an easement be put in place as properties were sold, so the easement could be continued <br />completely around the lake. He stated it was not his intent to take land away from the <br />existing homeowners, but when the homes were sold, the City should take an easement at <br />that time. <br />Mr. Laden asked if Mr. Cooke was in agreement to having a trail in his backyard. Mr. <br />Cooke replied it was his understanding that the City had an easement for this trail <br />because they were the ones who surveyed it and put in the Class 5, so he was not <br />objecting to having the trail in his backyard, as long as the trail continued entirely around <br />the lake at some point in the future. <br />Mr. Cooke believed this development was being rushed through until the Church sold its <br />property and if they waited, they would have a nicer development. <br />Mr. Houchins stated he also had the trail running through his backyard and it was his <br />preference the City maintain the vision of having the trail go around the lake rather than <br />running along the street. Mr. Tralle noted this was a very generous offer and most people <br />did not want a trail in their backyard. <br />Chair Rafferty asked what did the resident on Lot 3 think about the trail. Mr. Houchins <br />replied he was not sure, but he did not believe it bothered him either. He indicated they <br />had lived with this for 12 years and it did not bother him. <br />Chair Rafferty asked if they had a concern about people going on the private dock and <br />boardwalk.
