C <br />STAFF ORIGINATOR: Jeff Smyser <br />P & Z MEETING DATE: August 10, 2005 <br />TOPIC: Final Plat: Foxborough (Formerly Fox Den Acres) <br />BACKGROUND <br />The developer has changed the name of this project from Fox Den Acres to Foxborough. <br />The City Council approved the preliminary plat for the Fox Den Acres planned unit <br />development on January 10, 2005 with Resolution 04 -196. This project is the first to <br />implement the new parks and open space plan through the use of a conservation <br />development. The conservation development approach, while often discussed in Lino <br />Lakes in the past, has not previously been pursued to the extent being seen on this <br />project. <br />The total site is 50 acres and the permanent open space will include 28 acres, about 56 %. <br />The preservation of open space on this site will be an important step in the <br />implementation of the community's greenway vision. An overall conservation plan will <br />lay out what actions must occur to conserve and restore specified natural features of the <br />site. The homeowners association will prepare an annual implementation plan. The City <br />will review each annual implementation plan to make sure it is consistent with the overall <br />conservation plan. The City then will release funds for the activities described in the <br />annual plan. <br />ANALYSIS <br />The final plat itself is consistent with the approved preliminary plat. The City Attorney is <br />reviewing the title commitment and the City Engineer is finalizing the development <br />agreement. <br />The approval of the PUD included a number of conditions to ensure implementation of <br />the conservation development elements. Staff and the developer are making good <br />progress on completion of the overall conservation plan and the legal documents to <br />enforce it. These include the conservation easement conditions and the association <br />declarations and by laws, which will dictate how the City and the association will work <br />together to implement the overall conservation plan. <br />All these must be completed before the final plat is brought to the City Council for <br />approval. <br />
